These Terms and Conditions set out the basis on which Rubbish Removal West Hampstead provides rubbish removal and waste collection services. By booking or using our services you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.
1. Definitions
In these Terms and Conditions the following expressions shall have the meanings set out below.
Customer means the individual, business or organisation that requests or purchases rubbish removal or waste collection services from us.
Services means any rubbish clearance, junk removal, waste collection, loading, transportation, disposal, recycling or related services provided by us.
Waste means any items, materials, goods or substances presented by the Customer for collection, removal, transportation or disposal as part of the Services.
Work Site means the premises, property or location where the Services are to be carried out.
We, us and our mean the operator trading as Rubbish Removal West Hampstead providing the Services.
2. Scope of Services
We provide rubbish removal and waste collection services for domestic and commercial Customers, including but not limited to household clearances, garden waste removal, office clearances, and bulky waste collection.
The precise nature of the Services to be provided will be agreed at the time of booking, based on the information supplied by the Customer regarding the type, quantity and location of the Waste.
We reserve the right to refuse to remove any items which we reasonably consider to be hazardous, illegal, inadequately described, unsafe to handle or prohibited under applicable waste regulations.
3. Booking Process
Bookings may be made by telephone, email or through our online enquiry channels where available. All bookings are subject to availability and are not confirmed until we have provided a booking confirmation.
At the time of booking, the Customer must provide accurate and complete information about the Waste, including approximate volume or weight, type of materials, access conditions at the Work Site, parking restrictions and any other information relevant to the safe and efficient performance of the Services.
Any quotation provided prior to attending the Work Site is based on the information supplied by the Customer and is an estimate only. The final price may be adjusted if the Waste, access, parking or site conditions differ from what was originally described.
We will provide a provisional time window for attendance. While we make reasonable efforts to attend within the agreed time window, times are estimates only and may be affected by traffic, operational or safety considerations. We will not be liable for any loss or inconvenience arising from delayed arrival, provided we have used reasonable care and skill.
4. Access, Parking and Customer Responsibilities
The Customer is responsible for ensuring that we have safe, reasonable and lawful access to the Work Site for our staff and vehicles for the duration of the Services.
The Customer must arrange suitable parking and, where required, obtain any permits or permissions for our vehicles to park or load. Any parking charges, penalty charge notices or similar costs incurred as a direct result of inadequate information or permissions from the Customer may be added to the final invoice.
The Customer must ensure that the Waste to be collected is clearly identified and separated from any items not intended for removal. We accept no responsibility for removing items in error where they were not clearly distinguished from the Waste.
The Customer must ensure that the Work Site is safe and that any known hazards are brought to our attention prior to the start of the Services. We may refuse to carry out work where we reasonably consider that there is a risk to health, safety or property.
5. Pricing and Quotations
Our charges are generally based on factors such as the volume of Waste, its type and weight, the time taken to complete the job, access conditions and any disposal or recycling costs. We may provide guide prices based on estimated volume, with the final price confirmed on arrival once we have inspected the Waste.
All prices will be communicated in pounds sterling and, where applicable, will include VAT or clearly state whether VAT is additional. We reserve the right to revise our prices at any time, but any change will not affect a confirmed booking unless the description of the job proves to be inaccurate or incomplete.
If upon arrival we find that the Waste or site conditions differ substantially from the description given at the time of booking, we may either revise the quotation and seek the Customer's approval before proceeding, or decline to carry out the Services. If we decline to proceed due to such discrepancies, we may charge a call-out or attendance fee to cover our reasonable costs.
6. Payment Terms
Payment for our Services is due on completion of the job, unless otherwise agreed in writing in advance. For account Customers or larger commercial projects, alternative payment terms may be agreed and confirmed in writing.
We accept payment by cash, debit or credit card, bank transfer and certain other common payment methods. The acceptable methods of payment will be communicated at the time of booking or on the invoice.
Where payment terms have been agreed on account, invoices are payable within the period stated on the invoice. If no period is stated, the invoice is payable within 14 calendar days of the invoice date.
If the Customer fails to pay any sum due to us on the due date, we reserve the right to charge interest on the overdue amount at the maximum rate permitted under applicable law, accruing daily until payment is made in full. We may also suspend or withhold further Services until all outstanding amounts are settled.
7. Cancellations and Amendments
The Customer may cancel or amend a booking by contacting us as soon as possible. Cancellations or changes are only effective once acknowledged by us.
If the Customer cancels more than 24 hours before the scheduled arrival time, no cancellation fee will normally be charged. If the Customer cancels within 24 hours of the scheduled arrival time, we reserve the right to charge a reasonable cancellation fee to cover our costs, including any allocated resources and lost opportunities.
If our team arrives on site at the agreed time and is unable to carry out the Services due to lack of access, incorrect address, unsatisfactory site conditions or other reasons within the Customer's control, we may charge a call-out fee and any waiting time at our standard rates.
We reserve the right to cancel or reschedule a booking where it becomes impossible or impracticable to perform the Services due to circumstances beyond our reasonable control, including but not limited to extreme weather, vehicle breakdown, illness, accident or compliance with legal obligations. In such cases we will inform the Customer as soon as reasonably possible and will seek to offer an alternative appointment. We will not be liable for any indirect or consequential loss arising from such cancellations.
8. Waste Handling and Regulations
We operate in accordance with applicable UK waste management legislation and regulations. We take reasonable steps to ensure that Waste is collected, transported and disposed of or recycled lawfully and responsibly.
Certain types of Waste are classified as hazardous or require special handling, including but not limited to asbestos, chemicals, solvents, oils, clinical waste, gas bottles, tyres, and electrical or electronic equipment. The Customer must advise us in advance if any such items are present. We reserve the right to decline to remove such Waste or to charge additional fees to cover safe handling and disposal where we are appropriately licensed to do so.
Title to the Waste transfers to us at the point of collection, subject always to compliance with applicable waste regulations. We may recover, sort, recycle or dispose of the Waste at our discretion in accordance with the law.
The Customer warrants that the Waste presented for collection does not include prohibited, stolen or illegally obtained items and does not infringe third-party rights. The Customer will indemnify us in respect of any claims, penalties, costs or liabilities arising from a breach of this warranty.
9. Liability and Insurance
We will exercise reasonable care and skill in carrying out the Services. If we cause damage to property at the Work Site through our negligence, we will, at our option, repair the damage, compensate the Customer for the reasonable cost of repair or otherwise settle the matter in accordance with our insurance cover.
We will not be liable for any pre-existing damage or for damage arising from defects, weakness or inherent condition of the property, access routes, fixtures, fittings or items being removed. The Customer is responsible for protecting floors, walls, surfaces and other vulnerable areas if additional protection is required beyond what we reasonably provide.
We are not liable for any loss of profits, loss of business, loss of anticipated savings, loss of use, loss of data, or any indirect or consequential loss or damage arising from or in connection with the Services, whether in contract, tort or otherwise, even if foreseeable.
Our total aggregate liability to the Customer for all claims arising out of or in connection with the Services, whether in contract, tort or otherwise, shall not exceed the total amount paid or payable by the Customer for the specific Service giving rise to the claim, except where liability cannot be limited or excluded under law for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other matter that cannot be excluded by law.
We maintain appropriate insurance cover for our activities as required by applicable law and industry practice.
10. Complaints
If the Customer is dissatisfied with any aspect of the Services, they should contact us as soon as possible, providing full details of the issue. We will investigate the complaint and aim to respond within a reasonable time frame.
Where a complaint is upheld, we may, at our discretion, offer a partial refund, repeat the Service, or provide another form of resolution that we consider fair in the circumstances. Any remedial action will be agreed with the Customer.
11. Force Majeure
We shall not be in breach of these Terms and Conditions nor liable for any delay in performing, or failure to perform, any of our obligations where such delay or failure results from events, circumstances or causes beyond our reasonable control. These may include, without limitation, acts of God, extreme weather, strikes, lockouts or other industrial disputes, civil commotion, terrorism, war, accidents, breakdown of plant or machinery, fire, flood, road closures or compliance with any law or governmental order.
12. Data Protection and Privacy
We collect and process personal data relating to Customers only to the extent necessary to manage bookings, deliver the Services, handle payments, and address enquiries or complaints. We take reasonable steps to keep such data secure and to comply with applicable data protection legislation in the United Kingdom.
By providing personal information to us, the Customer consents to its use for the purposes described in this clause. We do not sell personal data to third parties. We may share information with service providers, insurers, payment processors and regulatory bodies where necessary to perform the Services, manage our business or comply with legal obligations.
13. Variation of Terms
We may amend or update these Terms and Conditions from time to time. Any changes will take effect when published or otherwise communicated to Customers and will apply to bookings made after that date. The Terms and Conditions in force at the time of booking will apply to that particular Service, unless a change is required by law or regulatory authority, in which case it may apply retrospectively to existing bookings.
14. Severability
If any provision of these Terms and Conditions is found by a court or competent authority to be invalid, unlawful or unenforceable, that provision shall be deemed deleted so far as necessary, and the remaining provisions shall continue in full force and effect.
15. No Waiver
Failure or delay by us in exercising any right or remedy under these Terms and Conditions shall not constitute a waiver of that or any other right or remedy. A waiver of any right or remedy will only be effective if given in writing and shall not be deemed a waiver of any subsequent breach or default.
16. Governing Law and Jurisdiction
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or with the provision of our rubbish removal and waste collection services, shall be governed by and construed in accordance with the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.
17. Entire Agreement
These Terms and Conditions, together with any written quotation or booking confirmation issued by us, constitute the entire agreement between the Customer and Rubbish Removal West Hampstead in relation to the Services. The Customer acknowledges that they have not relied on any statement, promise or representation not expressly set out in these documents.
By confirming a booking or allowing our team to commence work at the Work Site, the Customer confirms acceptance of these Terms and Conditions.
